By accessing or using the EB-5 Guide app (the "Platform"), you agree to these Terms of Use. If you do not agree, do not use the Platform. We may update these Terms, and continued use signifies acceptance of changes.
You must be 18 years of age (or the age of majority in your jurisdiction) to use the Platform.
The Platform is an informational directory. We are not a broker-dealer, investment adviser, law firm, or immigration consultancy; we do not sell securities, provide advice, negotiate transactions, handle funds or securities, or receive transaction-based compensation.
Some features may require registration and optional identity or phone verification, including one-time SMS codes. You must provide accurate information, safeguard your credentials, and you are responsible for all activity under your account.
You agree not to: • use the Platform for unlawful, fraudulent, or abusive purposes; • attempt unauthorized access, interfere with security, or disrupt operations; • scrape, harvest, or reproduce content without permission; • impersonate others or misrepresent your affiliation; • submit content that is misleading, unlawful, infringing, or harmful. We may suspend or terminate access for violations.
Project data may be provided by third parties or compiled from public sources. We do not control or endorse third-party content and are not responsible for accuracy, completeness, legality, or timeliness. Use third-party content at your own risk.
If you request information about a project, you authorize us to share your inquiry and contact details with the relevant project sponsor so they can respond. We are not a party to, and have no responsibility for, subsequent communications, agreements, or transactions.
The Platform may display advertising or sponsored listings. Paid placement does not constitute an endorsement or recommendation.
The Platform's design, text, compilations, logos, graphics, and software are owned by Zen in Tech LLC or its licensors and protected by law. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not copy, distribute, display, or create derivative works without prior written permission.
Content is for general information only and is not investment, legal, immigration, or tax advice. You should consult qualified professionals.
The Platform is provided "AS IS" and "AS AVAILABLE," without warranties of any kind. To the fullest extent permitted by law, Zen in Tech LLC and its affiliates are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or opportunities. Our aggregate liability will not exceed the amount you paid to us, if any, for access to the Platform.
You agree to indemnify and hold harmless Zen in Tech LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your content, or your breach of these Terms.
Project sponsors are solely responsible for ensuring their listings comply with applicable securities and immigration laws, including restrictions on general solicitation and investor eligibility. We may restrict visibility of certain content or features when legally required.
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflicts of law. You consent to exclusive jurisdiction and venue in state or federal courts located in Texas.
